Rubbish Removal Kingston Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Kingston provides rubbish removal and waste collection services. By making a booking, accepting a quotation or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.
These terms apply to all domestic and commercial customers using our waste clearance, rubbish removal, bulky item collection and related services within our service area. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, company or organisation that requests or receives the services from Rubbish Removal Kingston.
We, us, our means Rubbish Removal Kingston and any employees, agents or subcontractors acting on our behalf.
Services means any rubbish removal, waste collection, house or office clearance, garden waste removal, bulky waste removal, or related services we provide.
Booking means any order, request, agreement or arrangement made by the Customer for the provision of our services.
Waste means any items, materials, refuse, junk, furniture, appliances, debris or other goods that the Customer asks us to remove, excluding any prohibited or hazardous waste unless expressly agreed in writing.
2. Scope of Services
We provide on-demand rubbish removal and waste collection services, including but not limited to home clearances, office clearances, garden waste removal, light construction waste removal and general junk collection within our operating area.
The specific scope of work for each booking will be as agreed between you and us, based on the information you provide at the time of enquiry and confirmed during our on-site assessment where applicable.
We reserve the right to decline any job which, in our reasonable opinion, is unsafe, involves prohibited waste, exceeds our capacity, or falls outside our standard service offering.
3. Booking Process
3.1 You can request a booking by telephone, email or through any other communication method we make available. You must provide accurate and complete information about the type and approximate volume or weight of waste, access to the property, parking arrangements and any special requirements.
3.2 Any quotation given before we attend the site is an estimate only and is subject to confirmation once our team has inspected the waste and the access conditions. The final price may be adjusted to reflect the actual load size, weight, labour required and time spent.
3.3 Your booking is only confirmed when we have accepted it and provided you with a date and approximate time window for collection. We will make reasonable efforts to meet your preferred date and time but do not guarantee availability.
3.4 You must ensure that either you or an authorised representative is present at the property at the agreed time to give access, confirm the waste to be removed and approve any final pricing. If no one is present, we may, at our discretion, either wait for a reasonable period, charge a wasted journey fee, or rearrange the booking.
4. Access and Parking
4.1 You are responsible for providing safe and adequate access to the property, including any necessary entry codes, gate access or permissions from a managing agent or landlord.
4.2 You must ensure there is suitable parking or stopping space for our vehicle as close as reasonably possible to the collection point. Any parking fees, permits or fines incurred due to inadequate arrangements, inaccurate information or delays caused by the Customer may be charged to you.
4.3 If access is restricted or unsafe, or if we are unable to park within a reasonable distance of the collection point, we may either adjust the price to reflect the additional labour and time required or cancel the job and charge a wasted journey fee.
5. Pricing and Quotations
5.1 Our charges are generally based on the volume and type of waste removed, the weight of certain materials, the time taken to complete the job, and any additional labour or special handling required.
5.2 Any quotation provided in advance is an estimate based on information supplied by you. It is not binding until confirmed on site. If the actual waste, access or labour requirements differ from your description, we may revise the price before starting work.
5.3 We will explain any change in price to you on site and will only proceed with the service once you have agreed to the revised quotation. If you choose not to proceed, we may charge a call-out or wasted journey fee.
5.4 All prices are provided in pounds sterling and may be subject to applicable taxes or charges as required by law.
6. Payments
6.1 Payment is due in full on completion of the service, unless otherwise agreed in writing prior to the booking. We may require a deposit or full payment in advance for certain jobs.
6.2 We accept the payment methods notified to you at the time of booking or on site. You must ensure that you have the means to pay when the service is completed.
6.3 For business customers with approved accounts, payment terms will be as agreed in writing, typically within a specified number of days from the date of invoice. We reserve the right to charge interest and reasonable recovery costs on late payments.
6.4 If payment is not made when due, we may suspend further services to you and pursue any lawful means to recover the sums owed.
7. Cancellations and Amendments
7.1 You may cancel or amend a booking by contacting us directly. We ask that you provide as much notice as possible.
7.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply. If you cancel with less than 24 hours notice, we reserve the right to charge a reasonable cancellation fee or call-out fee to cover our costs.
7.3 If our team arrives on site at the agreed time and is unable to carry out the work due to lack of access, incorrect information, or your decision not to proceed, we may charge a wasted journey fee and any associated costs.
7.4 We may need to cancel or reschedule your booking due to vehicle breakdown, staff illness, severe weather, traffic disruptions, safety concerns or other factors beyond our control. In such cases, we will notify you as soon as reasonably practicable and offer an alternative date or a refund of any amounts paid in advance. We will not be liable for any indirect losses caused by such cancellations or delays.
8. Customer Obligations
8.1 You confirm that you are either the owner of the property and the waste, or that you have the full authority and permission of the owner to request our services and to allow us to remove the waste.
8.2 You must ensure that all waste you ask us to remove is clearly identified and separated where necessary. You must not include any prohibited, hazardous or illegal items unless we have expressly agreed in writing to collect them in compliance with applicable regulations.
8.3 You agree to provide accurate information about the nature of the waste, including any potentially sharp, heavy, fragile or awkward items, and any risks our operatives should be aware of.
8.4 You must keep pets, children and any bystanders away from the work area while our team is operating, and follow any health and safety instructions given by our staff.
9. Prohibited and Hazardous Waste
9.1 We comply with relevant UK waste regulations and hold or work under appropriate licences where required. There are certain types of waste we cannot collect, including but not limited to: asbestos, clinical or medical waste, biological waste, certain chemicals, solvents, oils, gas cylinders, explosives, and any substance classified as hazardous unless properly arranged in advance.
9.2 If we discover prohibited or hazardous items within the waste that were not declared at the time of booking, we may refuse to remove them, require an additional charge, or withdraw from the job entirely if it cannot be made safe.
9.3 You are responsible for any costs, fines, or liabilities arising from your failure to disclose hazardous or prohibited waste, or from any breach of waste regulations attributable to your actions or omissions.
10. Waste Handling and Disposal
10.1 Once payment is made and the waste is loaded onto our vehicle, ownership of the waste transfers to us, and we will handle, transport and dispose of it in accordance with applicable laws and regulations.
10.2 We aim to minimise landfill use and will, where reasonably practicable, segregate recyclable materials, reuse suitable items, and take waste to authorised recycling or disposal facilities.
10.3 We will not be responsible for any items left behind that were not clearly identified as waste, or which you did not expressly instruct us to remove.
11. Liability and Damage
11.1 We will exercise reasonable care and skill when providing our services. However, minor scuffs, marks or wear and tear may occur when removing large or heavy items, particularly in confined spaces. You should take reasonable steps to protect floors, walls and fixtures where necessary.
11.2 Our liability for any loss or damage to your property arising from our negligence will be limited to the reasonable cost of repair or replacement, subject to any exclusions permitted by law.
11.3 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of data, or loss of opportunity, arising out of or in connection with our services.
11.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
12. Insurance
12.1 We maintain appropriate insurance cover for our operations. Details of our insurance can be provided on request.
12.2 You are responsible for ensuring that your own insurance arrangements are adequate to cover any items or property not intended for removal, and any specific risks relating to your premises.
13. Complaints and Disputes
13.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible with full details of your concern. We take complaints seriously and will investigate promptly and fairly.
13.2 You must give us a reasonable opportunity to inspect any alleged damage or issue before you carry out repairs or disposal, so that we can assess responsibility.
13.3 We will attempt to resolve disputes amicably. If a dispute cannot be resolved, either party may seek to use any available dispute resolution method or pursue the matter through the courts.
14. Force Majeure
14.1 We shall not be liable for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to extreme weather, natural disasters, accidents, road closures, strikes, labour disputes, acts of government, or failure of utilities or transport networks.
14.2 If a force majeure event occurs, we will notify you as soon as reasonably practicable and, where possible, arrange a new collection date.
15. Data Protection and Privacy
15.1 We will collect and use your personal information only for the purposes of managing your booking, providing our services, handling payments, and communicating with you about our services.
15.2 We will take reasonable steps to protect your personal data and will not sell your information to third parties. We may share your details with trusted service providers, such as payment processors, solely for the purpose of delivering our services.
16. Variation of Terms
16.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that particular service.
16.2 Any changes will normally be published through our usual communication channels. It is your responsibility to review the current terms when making a new booking.
17. Severability
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services we provide, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services, save that we retain the right to bring proceedings against you in any other court of competent jurisdiction.
19. Entire Agreement
19.1 These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between you and us in relation to the services. They supersede any prior discussions, correspondence or understandings.
19.2 No employee, agent or representative of Rubbish Removal Kingston is authorised to vary these Terms and Conditions verbally. Any variation must be agreed in writing by an authorised representative.
